Terms of Service
Last updated 29 October 2026
- Phalsa gives your business an AI assistant that answers customers on WhatsApp and your website, books appointments and hands chats to your staff.
- You pay for the plan you choose. You can cancel any time; see the refund policy.
- Your customers’ data belongs to you. We only use it to run your assistant (see the privacy policy).
- Only message people who contacted you or agreed to hear from you, and follow WhatsApp’s rules.
- The assistant can make mistakes. Check what it is set to say, and take over any chat that needs a person.
1. Who we are and who these terms are for
Phalsa (“Phalsa”, “we”, “us”) is operated by Phalsa, India. These terms apply to any business or person (“you”) who creates a Phalsa account, pays for a plan or uses the Phalsa dashboard, website chat or WhatsApp assistant (the “Service”). By creating an account or paying, you accept these terms on behalf of your business, and you confirm you are at least 18 and allowed to act for it.
2. The Service
Phalsa answers enquiries from your customers, shares your services, prices and timings, books, reschedules and cancels appointments, sends reminders and follow-ups, collects answers to qualifying questions, and alerts your staff when a person is needed. Features depend on your industry, your plan and what you switch on. We may improve or change features; if we remove something important you pay for, we’ll tell you at least 30 days before.
WhatsApp messaging uses Meta’s WhatsApp Business Platform. Meta’s own terms and policies also apply to your WhatsApp account, and Meta may charge you directly for some conversations. We can’t control Meta’s approvals, outages, limits or charges.
3. Your account
- Give accurate details and keep your password private. You’re responsible for what happens in your account, including staff you add.
- Tell us straight away at hello@phalsa.ai if you think someone else got into your account.
- The Phalsa team may open your dashboard in “support mode” to set things up or fix a problem. Every such visit is logged and shown in our security log.
4. Plans, payment and renewal
- Prices are shown on our website and on your Billing page, in Indian rupees for businesses in India and in US dollars elsewhere. Prices include any taxes we are required to charge, unless your invoice says otherwise.
- The 7-day pilot is a one-time payment. The monthly plan is paid in advance for 30 days at a time; it doesn’t renew automatically — you pay again to continue. Paying before your plan ends adds 30 days to the end date.
- Payments are processed by Razorpay. We never see or store your card or bank details.
- If a plan isn’t renewed, your assistant may be paused after the end date. Your data stays available for you to download for at least 30 days.
- We may change prices for future periods with at least 30 days’ notice. The price you already paid for a period doesn’t change.
- Refunds are covered by our refund policy.
5. How you may use Phalsa
You agree not to use the Service to:
- send messages to people who haven’t contacted you or agreed to hear from you, or keep messaging someone who replied STOP;
- send spam, misleading offers, or content that is illegal, hateful, sexual, violent or infringes someone else’s rights;
- break WhatsApp’s Business and Commerce policies, or any law that applies to your business (including consumer, advertising, health, finance and data-protection laws);
- collect payment card numbers, passwords, government ID numbers or similar sensitive data through the chat;
- try to break, overload, copy or reverse-engineer the Service, or get into data that isn’t yours.
We may pause an account that breaks these rules or puts other users, customers or our WhatsApp access at risk. Where we can, we’ll warn you first and give you a chance to fix it.
6. The AI assistant
- The assistant answers from the details you give it (services, prices, timings, saved answers) and, if switched on, from an AI model. It can misunderstand or be wrong. You are responsible for the information you set and for checking important answers.
- It does not give medical, legal, financial or other professional advice, and isn’t a substitute for your staff. In emergencies it points people to emergency numbers.
- Your customers can always ask for a person. You agree to have someone respond to chats flagged for attention within a reasonable time.
- Tell your customers that they may be chatting with an automated assistant where the law requires it. Our assistant introduces itself as your business’s assistant.
7. Your data and your customers’ data
You own the content you add and the conversations with your customers. You give us permission to store and process it only to provide, secure and support the Service for you. For your customers’ personal data, you are the data fiduciary (controller) and Phalsa is your data processor; the data processing terms in our privacy policy form part of these terms.
You are responsible for having a lawful basis to message your customers and for telling them how their data is used — for example by linking to your own privacy notice. You can download all your data or close your account at any time from Settings → Team & account.
8. Availability and support
We work to keep Phalsa running around the clock, but we don’t promise it will never be interrupted — for example during maintenance, internet or power problems, or outages at Meta, Cloudflare or other providers. Support is by email at hello@phalsa.ai and by WhatsApp, on Indian working days.
9. Our intellectual property
Phalsa’s software, design, name and logo belong to us. You get a personal, non-transferable right to use the Service while your account is active. Feedback you send us may be used to improve Phalsa without any obligation to you.
10. Liability
To the extent the law allows: the Service is provided “as is”; we aren’t liable for indirect or consequential losses such as lost profits, lost bookings or lost data; and our total liability for any claim is limited to the amount you paid us in the 3 months before the event that caused it. Nothing in these terms limits liability that can’t be limited by law, such as for fraud.
You agree to cover us against claims caused by the content you set, the messages you send, or your breach of these terms or of the law.
11. Ending the agreement
You can stop using Phalsa and close your account at any time. We can end the agreement with 30 days’ notice, or straight away if you seriously break these terms. When an account is closed, we delete its data as described in the privacy policy, except records we must keep by law (such as payment records).
12. Changes to these terms
We may update these terms. For important changes we’ll tell you by email or in your dashboard at least 15 days before they apply. Continuing to use Phalsa after that means you accept the new terms.
13. Law and disputes
These terms are governed by the laws of India. We’ll first try to solve any problem informally — write to hello@phalsa.ai. If that doesn’t work, the courts in Hyderabad, Telangana have exclusive jurisdiction.
